These Terms and Conditions of Sale (“Terms”) govern the sale of products through the VANOU online store by VANOU, a French simplified joint-stock company (SAS), whose registered office is located at 2 chemin de la Guillermy, 13015 Marseille, France, registered under SIREN number 106 754 914 and SIRET number 106 754 914 00013, EU VAT number FR48 106 754 914, and which can be contacted at vanou@vanoustudio.com, to any individual acting for non-professional purposes, hereinafter referred to as the “Customer”.
By placing an order, the Customer fully and unconditionally accepts these Terms.
The products offered for sale are those presented on the VANOU online store, subject to availability.
VANOU takes the greatest care in presenting and describing its products. However, photographs and other representations are provided for illustrative purposes and slight variations in colour may occur depending on the screen used.
The essential characteristics of each product, including its composition, sizes and price, are indicated on the relevant product page.
Product prices are indicated in euros, including all applicable taxes (VAT included).
VANOU reserves the right to change its prices at any time. Products will, however, be charged at the price displayed at the time the Customer confirms the order.
Any applicable shipping costs are indicated before the order is finally confirmed. For mainland France, shipping costs €8 and is free for orders over €150. For other destinations served by VANOU, the applicable shipping costs are indicated during checkout according to the destination.
The Customer selects the products they wish to purchase and adds them to their cart. Before finally confirming the order, the Customer may review its details and total price and correct any errors.
The order becomes final once payment has been successfully confirmed. An order confirmation is sent to the email address provided by the Customer.
VANOU reserves the right to refuse or cancel an order in the event of suspected fraud, failure to pay, an incident relating to a previous order, or any other legitimate reason.
If a product becomes exceptionally unavailable after the order has been confirmed, VANOU will inform the Customer as soon as possible and refund the amounts paid for the relevant product.
Payment is made using the payment methods available on the online store at the time of the order.
Payments are securely processed by the payment service providers used by VANOU, including Shopify Payments. VANOU does not have access to the Customer’s full banking details.
An order is considered confirmed only once payment has been successfully authorised.
VANOU ships to mainland France, as well as Germany, Belgium, Spain, Italy, the Netherlands and Portugal.
Orders are prepared and dispatched as quickly as possible after order confirmation, except during exceptional periods indicated on the website.
For mainland France, orders are shipped via Colissimo with signature. Shipping costs €8 and is free for orders over €150. The estimated delivery time is 3 to 5 business days.
For orders shipped to the other European Union countries served by VANOU, delivery is made via Colissimo International with signature. Shipping costs €15. The estimated delivery time is 5 to 8 business days.
The Customer is responsible for ensuring that the shipping address provided when placing the order is accurate and complete.
Once the order has been dispatched, the Customer will receive a confirmation email containing the information required to track the shipment.
In the event of a significant delay or any difficulty regarding delivery, the Customer may contact VANOU at client@vanoustudio.com.
In accordance with applicable law, consumer Customers have fourteen (14) days from receipt of their order to exercise their right of withdrawal without having to provide a reason.
The Customer must inform VANOU of their decision within this period by contacting client@vanoustudio.com or by making any other unambiguous statement expressing their wish to withdraw. After exercising the right of withdrawal, the Customer has the applicable statutory period in which to return the relevant products.
Products must be returned in their original condition, unworn other than for the purposes of trying them on, unwashed, undamaged and with their original tags attached.
Return shipping costs are borne by the Customer. We recommend using a tracked shipping service.
Products returned incomplete, damaged, soiled or used beyond what is necessary to establish their nature, characteristics and size may be subject to a reduction in the amount refunded in accordance with applicable law.
Where the right of withdrawal has been validly exercised, VANOU will refund the amounts due in accordance with applicable legal provisions, using the same payment method used for the original order, unless the Customer expressly agrees to another method of reimbursement.
VANOU may withhold the refund until the returned products have been received or until the Customer provides proof that they have been dispatched, whichever occurs first.
Return shipping costs remain the responsibility of the Customer, except in the event of a defective or non-compliant product or an error attributable to VANOU.
If the Customer receives a defective product or a product that does not correspond to their order, they are invited to contact VANOU as soon as possible at client@vanoustudio.com, providing their order number and, where necessary, photographs identifying the issue.
Where the defect or error is attributable to VANOU, the necessary return shipping costs will be covered by VANOU in accordance with the instructions provided to the Customer.
These provisions do not limit the Customer’s statutory warranty rights.
Products sold by VANOU benefit from the applicable statutory warranties, including the legal guarantee of conformity and the warranty against hidden defects, under the conditions provided for by French law.
These statutory warranties apply independently of any commercial warranty that may be offered by VANOU.
VANOU shall not be held liable for failure to perform or improper performance of the contract where such failure is attributable to the Customer, a third party to the contract, or an event constituting force majeure.
In particular, VANOU shall not be held liable for consequences resulting from incorrect information provided by the Customer when placing an order.
These provisions shall not have the effect of limiting or excluding any rights granted to the Customer under mandatory consumer protection laws.
As part of managing orders and customer relationships, VANOU collects and processes certain personal data.
The terms governing the collection, processing and protection of such data are detailed in the Privacy Policy available on the website.
For any request relating to personal data, the Customer may contact VANOU at rgpd@vanoustudio.com.
All elements available on the VANOU website, including designs, products, photographs, texts, illustrations, graphics, logos and visual elements, are protected by applicable intellectual property laws.
Any unauthorised reproduction, representation, use or distribution, in whole or in part, is prohibited.
These Terms are governed by French law.
In the event of any difficulty or complaint relating to an order, the Customer is invited to contact VANOU first at client@vanoustudio.com in order to seek an amicable resolution.
VANOU reserves the right to amend these Terms at any time, in particular to reflect changes in its business activities or applicable regulations.
The Terms applicable to an order are those in force at the time the order is placed.
